GETTING TO KNOW YOU : COMPANY OR BUSINESS

According to the Financial Intelligence Act (“FIA”) of Botswana, attorneys are “Accountable Institutions” and certain obligations are placed on us. The FIA was introduced to combat money laundering
and other financial crimes. In order AKHEEL JINABHAI & ASSOCIATES to comply with the FIA, we are required to:

keep records of all transactions with clients;
establish and verify the identity of all clients, prior to rendering legal services; and
report “unlawful activities” and “suspicious and unusual transactions” to the Financial Intelligence Centre.

The FIA recognizes the principle of legal privilege despite the reporting obligations placed on this firm as an Accountable Institution. In terms of the FIA, we are now obliged to request more information from our clients than was the case in the past and, where appropriate, report such information to the Financial Intelligence Centre.

FIA DOCUMENTS REQUIRED FOR A COMPANY OR BUSINESS:

For compliance with the requirements of the Financial Intelligence Act, please provide us with the documents listed below.

Resolution confirming authority to deal with transactions (stamped by Company Secretary)
FOR SELLERS: If funds are paid to a third party, confirm third party details and receiving bank account in a stamped resolution

Kindly note: We are prohibited from paying out a third party without a legitimate reason and valid KYC supporting documents.

Proof of Source of Funds
(for entities making payments to AJA)

Certificate of Incorporation or RBN4 / Full Company File
(to determine beneficiary shareholding)

Proof of Income Tax Number
(Correspondence from BURS)

Proof of VAT Registration Number
(Correspondence from BURS – if applicable)

Proof of Physical Address of Company
(e.g. CIPA Extract or Utility Bill)

Share Certificates of all Shareholders
(optional)

Copies of IDs of Shareholders and Directors

Bank Letter / Bank Statement / Cancelled Cheque
(for Sellers / Agents / recipients of payment)

I / We confirm that the above in formation is true and correct to the best of my/ our knowledge and belief, and enclose copies of the requested verification documentation.

I / We understand that any transfer of funds to AKHEEL JINABHAI & ASSOCIATES account may require further disclosure of information relating to the source of the funds concerned, together with additional supporting documentation.

I / We accept that AKHEEL JINABHAI & ASSOCIATES may be obligated in law to disclose or pass such information to the Financial Intelligence Authority or otherwise in law to any successor or other applicable and competent regulatory body or authority.
